(“eBidList”, “we”, “us”, or “our”).  We provide our visitors and members (collectively, “you” or “your”) with an online network to connect consumers desiring certain services with providers of those services in their own region, as well as a number of related services (collectively, the “Services”).  Consumers post a listing indicating the services they are interested in purchasing (a “Listing”)  -- and a number of service providers have the ability to respond with a bid.  The consumer can then contact one, some or all of the service providers to select the winner.  We know you are concerned about your privacy, so we developed this Privacy Policy to explain how we collect, use, and disclose information from and/or about you.   This Privacy Policy describes our practices for all users of the Site and the Services (“Users”). We only provide certain services to Users who have established an account on the Site (such account, your “Account” and such Users, “Members”).

Children.

The Site is not directed to children and children are not eligible to use our Services.  Protecting the privacy of children is very important to us.  We do not collect or maintain Personal Information from people we actually know are under 18 years of age, and no part of our Site or Services is designed to attract people under 18 years of age. How We Collect Information. 

Personal Information

In general, the Personal Information we gather enables us to provide the Services to you and helps us learn more about the use of the Site and/or Services.  We collect Personal Information that you submit to us voluntarily. When you register with us and create an Account, we may ask you to provide certain Contact Information and other Personal Information, including a description of the services you provide if you are a service provider. When you pay fees for Services with your credit card, we collect your billing information to process that transaction (but only temporarily – we do not store your information longer than is necessary for us to process the transaction). We may request optional information to support your access to the Site or Services. When you communicate with us by sending us an email, we may collect and store any information that is contained in your communications with us.  You can choose not to provide us with certain information, but this may limit the features of the Site or Services you are able to use.

 

Listing Information

When you post a Listing, you are required to provide your geographic area (the more specific, the better) and zip code, an email address for us to contact you (we will not provide this to other Users) and a budget and description of the services you are seeking (“Listing Information”). Listing Information may also include photographs that you may, but are not required to, provide with your Listing. As your Listing Information is intended by you to be made available on the Site, your Listing Information (other than your email address) will not be considered Personal Information under this Agreement and we may use and disclose such Information in accordance with the license granted to us in the Terms of Service.

 

Anonymous Information

As you use the Site or Services, certain Anonymous Information may be passively collected and stored, such as your Internet protocol address, domain names, browser type, and access times.  We may also use Cookies (as defined below) and navigational data like Uniform Resource Locators (URLs) to gather information regarding the date and time of your visit and the solutions and information for which you searched and viewed. “Cookies” are small pieces of information that a website sends to your browser while you are viewing a website.  We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your browser until you delete them) to improve your experience on the Site (e.g., by keeping you logged in).  Persistent Cookies can be removed by following your Internet browser help file directions.  If you choose to disable Cookies, you may be logged out of the Site each time you view a page on the Site.

Listing Information

We will post your Listing Information (other than your email address) on the Site, and we may use such Listing Information as provided in the Terms of Service.

 

Anonymous Information

We may, through our use of Cookies, keep you logged into our Site, track your session history and collect your click-stream data. We may also tailor Site content to your interests and personalize your use of the Site. We may use your Anonymous Information to analyze usage patterns so that we may enhance the Site or Services, improve our internal operations, security and the content of our software, and customize the Site or Services for you.

 

How We Disclose Information.

Personal Information

We may disclose certain Personal Information:

·       To third party vendors who help us provide the Services or the Site;

·       To third parties to whom you ask us to send Personal Information (including other Users);

·       If you are a service provider, to Users whose Listings you have “bid” on, but only in the form of your Contact Information and any other information you authorize us in advance to disclose to such Users;

·       To a parent company, any subsidiaries, joint ventures, or other companies under a common control (collectively, “Affiliates”), in the event we have such Affiliates in the future, in which case we will require our Affiliates to honor this Privacy Policy;

·       To a company that merges with us, acquires us, or purchases our assets, in which case such company may continue to process your Personal Information as set forth in this Privacy Policy; or

·       If we believe in good faith that such disclosure is necessary to (a) resolve disputes, investigate problems, or enforce our Terms of Use; (b) comply with relevant laws or to respond to requests from law enforcement or other government officials relating to investigations or alleged illegal activity, in which case we can (and you authorize us to) disclose Personal Information without subpoenas or warrants served on us; or (c) protect and defend our rights or property or the rights and property of you or third parties.

 

We do not disclose the Personal Information of a User who posts a Listing to any other User.  We do, however, provide Users with the opportunity to communicate with each other through a messaging system on the Site.

 

Listing Information

This is a community-oriented Site.  If you post a Listing, you are welcome to share as much Listing Information as you think is necessary and appropriate. But please be aware than any Listing Information will be made available to all Users on the Site. We reserve the right to use the any information in a Listing you submit without restriction.

 

Anonymous Information

We may disclose Anonymous Information to:

·       Third party vendors who may help us enhance or provide the Site or Services; or

·       Third parties to whom you ask us to send Personal Information.

 

 

Accessing And Controlling Your Information.

You can review and/or change the Personal Information in your profile and/or certain of your Listing Information by logging into the Site and/or accessing your Account.  You must promptly update any information that you have provided to us (including your Personal Information and/or Listing Information) if it changes or becomes false or inaccurate. You authorize us to use and disclose any new or modified information that you provide in accordance with this Privacy Policy, and you agree that we are under no obligation to delete or modify information that you have previously chosen to provide us.  Please remember, however, if we have already disclosed some of your Personal Information or Listing Information to third parties, we cannot access that Personal Information or Listing Information any longer and cannot force the deletion or modification of any such information by the parties to whom we have made those disclosures.

 

Upon your request, we will close your Account and remove your Listing from the Site as soon as reasonably possible, in accordance with applicable law. Unless you otherwise opt-out, we will continue to use your Personal Information in accordance with this Privacy Policy even after we have closed your account.  If you opt-out, we may retain the Personal Information to comply with laws, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Terms of Use, and take other actions otherwise permitted by law.

 

Information Disclosed to Third Parties

This Privacy Policy addresses only our use and disclosure of information we collect from and/or about you. If you disclose information to others, including to other Users, the use and disclosure restrictions contained in this Privacy Policy will not apply to any third party.  We do not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable.

 

The Site may contain links to other websites that are not owned or controlled by us. We have no control over, do not review and are not responsible for the privacy policies of or content displayed on such other websites. When you click on such a link, you will leave our Site and go to another site.  During this process, another entity may collect Personal Information or Anonymous Information from you.

 

Changes to this Privacy Policy.
